What Happens If You Do Not Upgrade from TAE40116?

The requirement to upgrade from TAE40116 to TAE40122 is not a bureaucratic formality — it reflects a genuine regulatory obligation under the Standards for RTOs. For trainers and RTOs that do not act on the upgrade requirement, there are practical consequences worth understanding.
For trainers
If you are working as a trainer or assessor and have not yet upgraded to TAE40122, your qualification is not current under the national standards. This means:
- Your RTO may be non-compliant in having you deliver and assess while holding only TAE40116
- You may be restricted from taking on new training roles or contracts until your credential is current
- In an ASQA audit, your qualification status will be reviewed — and a TAE40116 without an upgrade pathway underway can contribute to an adverse finding
- As the VET sector increasingly recognises TAE40122 as the standard, holding TAE40116 may affect your competitiveness in the job market
For RTOs
RTOs are responsible for the qualification currency of their trainer workforce. Where trainers hold TAE40116, the RTO is expected to have a plan in place for upgrade. Failure to manage this can result in:
- Non-compliance findings during ASQA audits — particularly under Standard 1, which addresses the competency of trainers and assessors
- Conditions being placed on RTO registration
- Reputational risk if qualification issues become visible to partner schools, clients or learners
What if the upgrade is in progress?
Where a trainer has commenced the upgrade pathway, this is typically noted as a mitigating factor in an audit context. RTOs should ensure that any trainers on an upgrade pathway have a documented plan and a realistic completion timeline.
